What is attorney review in New Jersey?

Every standard New Jersey residential contract goes through a three-business-day attorney review. Either side's attorney can change the contract or cancel it outright during that window, for any reason. A letter that “disapproves” the contract is the normal first move, not the deal falling apart. I wrote the long version here.

Do I need a real estate attorney to buy in New Jersey?

It is not legally required, but it is standard practice here and I would not buy without one. Most handle a residential purchase for a flat fee — ask for that number up front so it is not a surprise at closing.

How much do I need for a down payment?

It depends on the loan, not on a rule of thumb. There are programs that start low and loans that want more, and condos in some buildings have their own requirements. Get pre-approved first and you will know your real number instead of a number from the internet.

What do I have to sign before you can show me homes?

Since August 2024, agents have to have a written agreement with you before touring a home. It sets out what I do and how I am paid. It can be limited — one property, one day, or a full engagement — and we talk about it before you sign anything.

Who pays my agent now that the rules changed?

Sellers are no longer required to cover the buyer's agent. Sometimes they still offer to, sometimes it is negotiated into the deal, sometimes the buyer pays directly. It is a term of the transaction now, so we discuss it before we start looking.

How long does it take to buy a home here?

From accepted offer to keys, a mortgage purchase usually runs about two months, sometimes faster with cash. The steps that move the clock are attorney review, inspection, the appraisal and your lender's commitment.

What does an inspection actually catch?

Condition: roof, systems, water, structure, safety. It does not catch what is behind walls, and it is not a valuation. Bring an inspector who explains what matters versus what is a punch list item.

What are closing costs in New Jersey?

For buyers it is generally lender fees, title insurance and search, attorney, and the escrow the lender collects up front for taxes and insurance. The exact total depends on price, loan and town, so I would rather show you a real estimate for the property you are actually buying.

Should I get pre-approved before looking?

Yes, and not just for your own budget. In a competitive building a pre-approval is the difference between an offer that gets read and one that gets filed.

Is it better to buy or keep renting in Hudson County?

It turns on how long you will stay and what you would pay in rent for the same space. Under two or three years, the transaction costs usually win. Longer than that, it is worth running the numbers properly — and I will run them honestly, even when the answer is keep renting.

What is the difference between pre-qualified and pre-approved?

Pre-qualified is a conversation; pre-approved means a lender has looked at your documents. In a competitive building only the second one counts.

What do condo fees cover, and can they go up?

Typically building staff, insurance, common areas, reserves and sometimes heat or water — it varies by building. They can rise, and a building with thin reserves is the one that surprises you with an assessment. I read the minutes before you buy, not after.

How do you price my home?

From what is actually closing on your block and in your building, not from an automated estimate. Same line, same floor and same tier matter more than the town average. Here is how I do it.

What is my home worth?

I will tell you, in writing, usually the same day — but not over the phone before I have looked at comparable sales and the condition of the place. Request a valuation here.

Are agent commissions set?

No. Commission is negotiable and always has been. What changed in 2024 is how it is disclosed and agreed, which is a good thing for everyone.

Should I renovate before selling?

Usually less than people expect. Paint, light, and the fixes that show up in an inspection tend to pay. Full kitchens rarely return what they cost if you are selling within a year. Ask me before you spend.

How long will it take to sell?

It depends on price, building and season more than the market in the abstract. The honest answer is that correctly priced homes here move quickly and overpriced ones sit and then sell for less than they would have.

Do I have to fix everything the inspection finds?

No. Inspection items are negotiated. Some are worth doing, some are worth crediting, and some are worth declining. That negotiation is most of what you hire me for.

What are the seller's costs at closing?

Commission as agreed, attorney, payoff of your mortgage, and the New Jersey realty transfer fee, which scales with price. If you are not a New Jersey resident there may be tax withholding at closing — worth planning for early.

Should I sell first or buy first?

Selling first is safer financially; buying first is easier logistically. Which is right depends on whether you can carry both for a period. We map it out before either is listed.

What happens if my home does not appraise?

The buyer's lender will only lend against the appraised value, so the gap has to be closed by the buyer, by the price, or the deal ends. Pricing to real comparables in the first place is how you avoid the conversation.

Should I always take the highest offer?

No. The highest number with a shaky loan, a long close and a nervous buyer is worth less than a slightly lower offer that actually closes. I look at the whole offer, not just the top line.

What does “no fee” actually mean?

It means the landlord is paying the broker instead of you. It does not mean nobody is paid. The renter's checklist is here.

What is a broker fee, and is it negotiable?

It is the fee for the agent who rented you the apartment, commonly quoted as a share of a year's rent or a month's rent. It varies by building and market, and yes, it can be negotiated — especially when a unit has been sitting.

What do I need to apply for an apartment?

Usually photo ID, recent pay stubs or an offer letter, bank statements, and a credit check. Have them as one PDF before you tour. In a tight building, the complete application wins over the fast one.

How much income do landlords want to see?

Most want to see a comfortable multiple of the rent, and many will accept a guarantor if you are close. The threshold varies by landlord, so ask before you pay an application fee.

Can my landlord raise the rent whenever they want?

Not always. Several Hudson County municipalities, including Jersey City, have rent control that applies to some buildings and not others. Whether yours is covered depends on the building's age and type — check before you sign a renewal.

What should I look at during a showing that people forget?

Water pressure, cell signal, what the windows face, where the trash goes, and how long the walk to the PATH really takes at 8am rather than on a map.

When should I start looking for a rental?

About four to six weeks before you need to move. Earlier than that and the good listings are not posted yet; later and you are choosing from what is left.

What are the rules on security deposits in New Jersey?

New Jersey limits what a landlord can hold and sets a deadline for returning it with interest after you move out, along with an itemised list of any deductions. If yours is late or unexplained, that is not normal — ask.

Can I negotiate on a rental?

More often than people think, especially outside peak season or on a unit that has sat. Rent, the broker fee, the start date, a parking space, a repaint — all fair game.

Do landlords here accept pets?

Some do, some do not, and many charge more or restrict size or breed. Tell me up front and I will filter properly instead of wasting your Saturdays.

What do I have to do before I can legally rent out my place in New Jersey?

Register the property with the municipality (and file a landlord registration statement), get the certificate of occupancy or continued-occupancy inspection your town requires, and give every tenant the state's Truth in Renting statement at or before move-in. Towns differ on the inspection — Jersey City, Hoboken and Bayonne do not run it the same way.

What is the lead-safe certification, and does it apply to me?

If your rental was built before 1978 and is not exempt, New Jersey requires a lead-based paint inspection — at tenant turnover or on the state's cycle — and the certification has to be given to the tenant and attached to the lease. Most of Hudson County's housing stock predates 1978, so assume it applies until someone tells you otherwise.

Do I have to tell tenants about flood risk?

Yes. Since March 2024 New Jersey landlords must give written notice if the property sits in a Special or Moderate Flood Hazard Area, and disclose known prior flooding. On this waterfront that is not a formality.

How much rent can I actually charge?

What the block supports, not what a portal estimate says — and in a rent-controlled building, what the ordinance allows. I price rentals the same way I price sales: recent signed leases in comparable lines, not asking prices.

Does rent control apply to my building?

It depends on the municipality, the building's age and how many units it has. Jersey City, Hoboken, Union City and others each have their own ordinance and their own exemptions. Check the specific address before you plan an increase — the answer changes street to street.

How do I screen a tenant properly?

Consistent criteria applied to everyone: income, credit, references, and verification that the documents are real. Consistency is also your fair-housing protection — deciding case by case is how landlords get into trouble.

Can I refuse a tenant who uses a housing voucher?

No. New Jersey prohibits discriminating against a renter because of a lawful source of income, vouchers included. You can still apply your normal income and credit standards to the tenant's share.

What if I need the tenant out?

New Jersey's Anti-Eviction Act means you need a lawful ground and a proper court process — you cannot simply decline to renew a lease the way landlords can in some states. Talk to a lawyer before serving anything, not after.

Should I use an agent to rent my unit, or list it myself?

If it rents itself, do it yourself. Use an agent when you want it priced right, marketed to the people who actually pay your number, tenants screened consistently, and the lease and disclosures done correctly. And if you would rather not think about the building at all, ask me about management.

Do you manage properties as well as rent them?

It is launching. Is Hudson County a good place to invest?

For rental demand, the fundamentals are transit and jobs, and both are strong here. Whether a specific building works is an arithmetic question, not a market question — and the arithmetic differs by street.

What is a cap rate, in plain terms?

Annual income after operating expenses, divided by what you paid. It lets you compare two buildings honestly. It ignores financing, which is why two investors can pay different prices for the same building and both be right.

What should I know about two-family and multi-family here?

Hudson County's older housing stock is full of two- and three-families, and they are a genuine path to owning with rent covering part of the note. Zoning, certificates and what counts as a legal unit vary block to block. Here is the breakdown.

Can I live in one unit and rent the others?

Yes, and it changes what financing you can use. It also makes you a landlord, with the obligations that come with it — registration, inspections and the local rules that apply.

What do property taxes do to the numbers?

More than people expect, and they vary sharply between towns. Never underwrite a Hudson County deal on the taxes the current owner pays without checking whether an assessment is due.

Do you work with out-of-state or overseas investors?

Yes, including in Romanian. Expect me to be blunt about which buildings do not work rather than sending you everything that is listed.

Do short-term rentals work in Jersey City?

Jersey City tightened its short-term rental rules significantly, and what is allowed depends on the building, whether you live there and how the unit is registered. Never underwrite a purchase on short-term income without checking the current ordinance for that address.

How do I estimate renovation costs before I buy?

Walk it with a contractor during your inspection window, not after closing. In older Hudson County stock the expensive surprises are usually electrical, plumbing stacks and anything involving the roof or facade — not kitchens.
